Romanian prosecutors have once again failed in their attempt to place Andrew Tate behind bars, as the Bucharest Court of Appeal rejected their appeal to remand the divisive internet figure into custody. Despite DIICOT’s efforts to push for pre-trial detention in a second human trafficking investigation that involves minors, Tate will remain under house arrest. His brother, Tristan Tate, also remains under judicial control, but both men continue to avoid being placed in remand custody, which has been a key goal for the Romanian authorities.


This latest ruling allows the Tates some relief, with certain restrictions on their communication with alleged victims being lifted. Their spokesperson, Mateea Petrescu, framed this as a recognition of their family ties, stating that the brothers are now free to meet and communicate with the victims, given the close relationships and shared children involved in these cases. Both Andrew and Tristan vehemently deny the allegations.


Following the decision, Andrew Tate took to X (formerly Twitter), accusing prosecutors of making a "desperate attempt" to incarcerate them without sufficient evidence. This isn’t the first time Tate has claimed that his legal battles are politically motivated, having consistently maintained that he is the target of a conspiracy to silence him due to his controversial views.


The court's decision comes in the wake of a fresh DIICOT investigation, which includes allegations of human trafficking, sexual relations with minors, and money laundering. DIICOT alleges that between 2014 and 2024, the Tate brothers and their associates exploited 34 vulnerable victims, many of whom were coerced into producing pornographic content for profit. The total revenue allegedly generated from these activities is estimated at over €2.5 million. The new charges only add to their existing legal troubles, with the brothers already awaiting trial in a separate human trafficking case.


Though the court has ruled in favor of maintaining their house arrest, Romanian law enforcement continues to monitor their movements closely. Prosecutors are particularly concerned about the brothers' alleged involvement in the coercive "loverboy" method, which has long been a focus of their investigation. Despite these concerns, and several raids conducted on properties associated with the brothers, the Romanian judiciary remains reluctant to remand the Tates into pre-trial detention, much to the frustration of DIICOT.


However, while the court has once again stopped short of placing the Tate brothers in Rahova Prison, the looming possibility of a remand remains real. The decision not to incarcerate them, despite DIICOT's best efforts, still leaves the brothers with the freedom to potentially flee Romania—a scenario that has raised concerns both locally and internationally. Given the raft of international arrest warrants that would likely be triggered if they attempted to leave, the only viable destination for the Tates at this point would be Russia. This prospect of escape has long been speculated, and with the new charges stacking up and the potential for long sentences in both this case and the earlier one, fleeing to Russia may appear to be their best remaining option.


From the Tates’ perspective, Russia offers not only a safe haven, given its reluctance to comply with Western extradition treaties, but also a potential opportunity to continue influencing their vast online following from a place where political asylum could be within reach. With increasingly lengthy sentences now likely if convicted, the incentive to escape is growing by the day. These next few weeks may prove to be a critical turning point for the brothers and the case as a whole.
